Welcome to ChemCab (“we,” “us,” “our”). By accessing or using our services, including our website, client portal, driver network, dispatch system, or any related tools (collectively, the “Platform”), you (“Client,” “you,” “your”) agree to these Terms of Service.
1. Platform & Service Description
ChemCab operates a technology-enabled logistics platform that facilitates the transport of chemical, gas, petroleum, environmental, and laboratory samples. ChemCab coordinates delivery requests through its systems but does not guarantee availability, timing, or outcome of any specific service.
All jobs must be submitted through the ChemCab Client Portal or approved communication channels. Completed jobs include time-stamped proof of delivery, photographs, driver signatures, and automated invoicing.
2. Client Account
To use ChemCab services, you must maintain an active Client Portal account. You are responsible for ensuring all account, billing, and contact information is accurate and up to date.
ChemCab reserves the right to approve, deny, suspend, or terminate any account at its sole discretion, with or without notice.
3. Job Requests & Client Responsibilities
By submitting a job request, you agree that:
All pickup and delivery information is accurate and complete
Samples are properly packaged, secured, and labeled in compliance with all applicable regulations
Hazardous materials are fully disclosed
Chain-of-custody requirements are communicated in advance
You are solely responsible for compliance with all applicable laws, regulations, and safety standards related to the materials being transported.
ChemCab reserves the right to refuse, delay, or cancel any job that is unsafe, non-compliant, or operationally unfeasible.
4. Access & Failed Delivery Attempts
Clients are responsible for ensuring drivers have safe, timely, and authorized access to all pickup and delivery locations.
If a job cannot be completed due to:
Incorrect or incomplete information
Unavailable contacts
Denied facility access
Delays at pickup or drop-off locations
the job may still be considered completed or billable, including any applicable wait time or return trip charges.
5. Pricing, Billing & Additional Charges
ChemCab charges based on distance, time, route complexity, and service conditions.
By submitting a job, you authorize ChemCab to invoice your account automatically.
Additional charges may apply for:
Wait time or detention
Extended site delays
Return trips or re-deliveries
After-hours or priority service
Invoices are due upon receipt unless otherwise agreed in writing.
Failure to pay may result in:
Account suspension
Service refusal
Late fees or collections
6. Turnaround Times (ETA/ETC)
Estimated pickup and delivery times (ETA/ETC) are provided for convenience only and are not guaranteed.
ChemCab is not liable for delays caused by:
Traffic, weather, or road conditions
Site access issues or delays
Incorrect client-provided information
Facility restrictions or safety requirements
7. Proof of Delivery (POD)
All completed deliveries include:
Time-stamped Proof of Delivery
Photographs of samples
Driver signature
Digital confirmation
Proof of Delivery constitutes final confirmation that the service has been completed.
8. Independent Contractor Relationship
Drivers and delivery personnel operating on the ChemCab Platform are independent contractors and are not employees of ChemCab.
ChemCab acts solely as a coordination platform and is not responsible for the independent actions of drivers beyond the scope of facilitating delivery services.
9. Liability & Limitations
ChemCab is not responsible for:
Improperly packaged or labeled materials
Leaks, spills, or contamination caused by client packaging
Sample degradation due to time, temperature, or inherent properties
Testing delays, lost revenue, or consequential damages
Maximum liability for any claim is limited to the amount paid for the specific delivery in question.
You agree to indemnify and hold ChemCab harmless from any claims, damages, or liabilities arising from:
Misrepresentation of materials
Regulatory violations
Improper packaging or handling
10. Hazardous Materials Compliance
Clients certify that all materials comply with:
DOT 49 CFR regulations
OSHA standards
All applicable federal, state, and local laws
ChemCab reserves the right to refuse any material that presents a safety or compliance risk.
11. Privacy & Data Use
ChemCab collects and uses data solely for operational purposes, including dispatching, tracking, communication, invoicing, and compliance.
We do not sell or share client data with marketers or unrelated third parties.

12. Force Majeure
ChemCab is not liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:
Natural disasters
Severe weather
Industrial incidents
Government actions or restrictions
System outages or infrastructure failures
13. Account Suspension & Termination
ChemCab may suspend or terminate accounts for:
Non-payment
Fraud or misrepresentation
Unsafe or non-compliant practices
Abusive behavior
Violation of these Terms
Clients may terminate their accounts through the Client Portal.
14. Governing Law
These Terms are governed by the laws of the State of Texas, depending on the applicable service region.
15. Changes to These Terms
ChemCab reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of any updated Terms.
